USER COMMITMENTS
The USER guarantees that they are over 14 years of age and that the information provided is accurate and truthful.

PLEXUS maintains various pages and/or profiles on different social media platforms linked through this Website. EMAILS SENT BY PLEXUS
If PLEXUS sends emails within the framework of the contractual relationship with the recipient, we inform you that the information included in such emails or attached files may be confidential. Accessing and/or disclosing the contents of an email is classified as an offence under Article 197 of the Spanish Penal Code.
If you are not the intended recipient, you are hereby informed that any use, distribution, disclosure, or reproduction of this information without the express permission of the legitimate recipient is prohibited under applicable law.
We kindly ask you to notify us immediately via the same channel or by phone and to delete the email.
Email communication does not guarantee the confidentiality, integrity, or correct reception of transmitted messages.
SECURITY MEASURES
PLEXUS has adopted the necessary technical and organisational measures to ensure the security of personal data and prevent its alteration, loss, processing, or unauthorised access, taking into account the state of the technology, the nature of the data stored, and the risks to which they are exposed, whether they come from human actions or the natural physical environment.
However, the USER must be aware that security measures on the Internet are not impregnable.
DATA RETENTION IN ACCORDANCE WITH THE LSSI
PLEXUS informs that, as a data hosting service provider and in accordance with the provisions of Law 34/2002 of 11 July on Services of the Information Society and Electronic Commerce (LSSI), it retains the minimum necessary information to identify the origin of hosted data and the moment when the service provision started, for a maximum period of 12 months. The retention of this data does not affect the confidentiality of communications and may only be used in the context of a criminal investigation or to safeguard public security, and will be made available to judges and/or courts or the relevant Ministry if required.
Data communication to the law enforcement authorities will be carried out in accordance with the applicable personal data protection regulations.
INTELLECTUAL PROPERTY RIGHTS
PLEXUS is responsible for all copyrights, intellectual property, industrial rights, “know-how,” and other rights related to the content of the website and the services offered on it, as well as the programmes necessary for its implementation and related information.
Reproduction, publication, and/or use of the total or partial content of the website https://www.plexus.es/ for anything other than strictly private purposes is not permitted without prior written consent.
INTELLECTUAL PROPERTY OF THE SOFTWARE
The user must respect third-party programmes made available by PLEXUS, even if they are free and/or publicly available.
PLEXUS holds the necessary exploitation and intellectual property rights of the software.
The user does not acquire any rights or licences with respect to the software required for the provision of the service, nor to the technical information for service monitoring, except for the necessary rights and licences to comply with the contracted services, and only for the duration of these services.
For any action exceeding the fulfilment of the contract, the user will need written authorisation from PLEXUS. It is prohibited for the user to access, modify, or view the configuration and structure of PLEXUS’s servers, assuming civil and criminal responsibility for any incidents that may occur in the servers and security systems as a result of negligent or malicious actions on their part.
INTELLECTUAL PROPERTY OF HOSTED CONTENT
The use of services provided by PLEXUS in a way that is contrary to intellectual property legislation is prohibited, and specifically:
- The use that violates Spanish laws or infringes the rights of third parties.
- The publication or transmission of any content that, in the opinion of PLEXUS, is violent, obscene, abusive, illegal, racial, xenophobic, or defamatory.
- Cracks, serial numbers for programmes, or any other content that infringes third-party intellectual property rights.
- The collection and/or use of personal data from other users without their express consent or in violation of Regulation (EU) 2016/679 of the European Parliament and Council, of 27 April 2016, concerning the protection of individuals with regard to the processing of personal data and the free movement of such data.
- The use of the domain’s mail server and email addresses to send unsolicited bulk mail.
The user is fully responsible for the content of their website, the information transmitted and stored, hypertext links, third-party claims, and legal actions related to intellectual property, third-party rights, and child protection.
The user is responsible for complying with the current laws and regulations regarding online services, e-commerce, copyright, the maintenance of public order, and universal internet usage principles.
The user shall indemnify PLEXUS for any costs that may arise from the attribution of Tecnologías Plexus, S.L. in any cause for which responsibility is attributable to the user, including legal defence fees and expenses, even in the event of a non-final court decision.
PROTECTION OF HOSTED INFORMATION
PLEXUS makes backup copies of the content hosted on its servers; however, it is not responsible for the accidental loss or deletion of data by users. Similarly, it does not guarantee the full restoration of data deleted by users, as such data may have been deleted or modified during the time elapsed since the last backup.
The services offered, except for specific backup services, do not include the restoration of content kept in backups made by PLEXUS if the loss is attributable to the user. In such cases, a fee will be determined based on the complexity and volume of the recovery, subject to the user’s prior acceptance.
Restoration of deleted data is only included in the service price when the loss of content is due to causes attributable to PLEXUS.
COMMERCIAL COMMUNICATIONS
In compliance with the LSSI, PLEXUS will not send unsolicited advertising or promotional communications via email or other electronic communication means unless they have been previously requested or expressly authorised by the recipients. In the case of users with whom there is a prior contractual relationship, PLEXUS is authorised to send commercial communications concerning products or services of Tecnologías Plexus, S.L. that are similar to those initially contracted with the client.
In any case, the user, after proving their identity, may request not to receive further commercial information through Customer Service channels.
